Terms of Service
Frogus Cloud ("we") provides virtual private servers (VPS). These terms apply to all clients, wherever they are located. By registering in the client area, you accept these terms and the Acceptable Use Policy.
1. Definitions
1.1. Website: froguscloud.ru and its subdomains.
1.2. Client area: my.froguscloud.ru, where you order, pay for, and manage services.
1.3. Server: a virtual private server (VPS), a portion of computing capacity allocated to you (CPU cores, memory, disk, and IP addresses) that is permanently connected to the internet.
1.4. Configuration: the set of server resources you have chosen.
1.5. Balance: the amount of prepayment in the client area.
1.6. Billing period: a month or another term chosen when ordering.
2. Getting started
2.1. To use the services, register in the client area, accept these terms and the Acceptable Use Policy, and top up your balance. The date and time of acceptance are recorded in the client area.
2.2. We may ask you to verify your phone number or payment method; this protects us against fraud and abuse from new accounts. Without verification, the server may not be created.
2.3. Provide accurate information and update it when it changes.
3. Provision of services
3.1. The server is created automatically after payment. Access to it is provided in the client area.
3.2. You administer the server yourself: you install software, update the system, configure security, and back up your data. We do not log in to your server or view its contents, except in the cases described in the Acceptable Use Policy.
3.3. We carry out scheduled maintenance after giving at least 24 hours' notice by email or in the client area. Urgent work to fix outages and security threats is carried out without notice.
3.4. We aim to keep servers available 99.5% of the time each month.
3.5. If a server was unavailable through our fault (due to a failure of our hardware or network, or our error) continuously for more than 15 minutes, we extend that server's paid period by the duration of the downtime, rounded up to whole days. We do this ourselves within 5 business days after the outage is resolved; you can also report the downtime to support.
3.6. The following do not count as unavailability through our fault: scheduled maintenance under clause 3.3; a DDoS attack on your server and measures to mitigate it; your actions and the actions of third parties who gained access to the server through your fault; suspension under section 7; access restrictions imposed by telecom operators and government authorities, including throttling or blocking of traffic in telecom operators' networks; force majeure.
3.7. The server is connected to the network via a port with a peak speed of up to 1 Gbit/s; the hardware uplink is shared by the servers hosted on it, so a constant speed is not guaranteed. Traffic volume is not capped; the speed after 5 TB of outbound traffic per month is governed by the Acceptable Use Policy.
4. Prices and payment
4.1. Prices are listed on the website and in the client area. The billing currency and payment methods are shown in the client area.
4.2. Services are paid in advance: the cost of a billing period is charged to the balance at its start.
4.3. When the paid period ends, the server is renewed automatically for the same period if the balance has sufficient funds. You can turn off auto-renewal or change its period in the client area. We send advance email reminders about the end of the period and insufficient funds.
4.4. If funds are insufficient by the end of the paid period, the server is suspended (the check runs several times a day, so suspension may occur within a few hours). After payment, the server is resumed automatically. After 7 days of suspension, the server and its data are deleted permanently and cannot be recovered; we warn you about this by email.
4.5. Prices may change: we give at least 14 days' notice of new prices. A period that has already been paid is not recalculated.
4.6. You may cancel the services at any time and request a refund of the unused balance. We refund within 10 business days using the same method the money was paid with. If you cancel a server paid for 3 or 12 months at a discount, the time used is charged at the monthly rate, and the remainder is returned to the balance.
5. Changing the configuration
5.1. Server resources (CPU cores, memory, disk) can only be increased. The additional charge for the increase until the end of the paid period is deducted from the balance immediately.
5.2. To downgrade the configuration, order a new server with a smaller configuration, move your data to it, and delete the old one; the remainder for the old server is returned to the balance under clause 4.6.
6. Liability
6.1. We are not liable for the information you host, for the consequences of your actions and the actions of third parties who gained access to the server through your fault, or for the loss of data you did not back up.
6.2. Our liability under these terms is limited to the amount you paid for the affected service for the last billing period, and for server unavailability, to the extension under clause 3.5. Consumer rights that cannot be limited under the law of the client's country are not limited by this clause.
6.3. Neither party is liable for failure to perform these terms due to force majeure, including failures of backbone communication networks and actions of government authorities.
7. Suspension and termination
7.1. We may suspend the services: in case of a violation of the Acceptable Use Policy, in the manner described in it; immediately, if the server takes part in an attack, sends spam, distributes malware, or otherwise threatens the operation of networks; in case of non-payment; upon a lawful request from competent authorities.
7.2. In case of a repeated or gross violation of the Acceptable Use Policy, we may terminate the services. The unused balance is refunded, except for amounts needed to compensate for proven damages caused by the violation.
7.3. You may stop using the services at any time by deleting your servers and requesting a refund of the remaining balance.
8. Personal data
8.1. How we process your data is described in the Privacy Policy.
9. Questions and disputes
9.1. Send claims and questions to support@froguscloud.ru. We reply within 10 business days. We try to resolve disagreements through negotiation.
10. Changes to the terms
10.1. We publish a new version on the website and send it by email at least 14 days before it takes effect. If you continue to use the services after that, the new version applies.
